These Terms of Service ("Terms") govern your access to and use of the website located at FederationFuels.com (the "Site") operated by Federation Fuels, a division of BPM Services, Inc. ("Company," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Site.

These Terms apply to all visitors, users, and others who access or use the Site. Additional terms and conditions may apply to specific services, which will be presented to you at the time of engagement.

1. USE OF THE SITE

You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Site in any way that violates any applicable federal, state, local, or international law or regulation
  • Transmit any material that is defamatory, obscene, fraudulent, or otherwise objectionable
  • Attempt to gain unauthorized access to any portion of the Site, other accounts, computer systems, or networks connected to the Site
  • Use any automated means, including robots, crawlers, or scrapers, to access the Site for any purpose without our express written permission
  • Interfere with or disrupt the operation of the Site or the servers or networks used to make the Site available
  • Impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity

2. SERVICES AND QUOTES

The Site provides information about Federation Fuels' products and services, including fuel delivery, logistics, and related offerings. Information presented on the Site is for general informational purposes only and does not constitute a binding offer.

Quote requests submitted through the Site are requests for pricing information only. A binding agreement for services is not formed until a separate written service agreement, work order, or purchase order is executed by both parties. All service agreements are subject to the Company's standard terms and conditions, which will be provided at the time of engagement.

Pricing, availability, and service terms are subject to change without notice. The Company reserves the right to refuse service to anyone for any reason at any time.

3. INTELLECTUAL PROPERTY

The Site and its entire contents, features, and functionality — including but not limited to all text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software — are the property of the Company, its licensors, or other providers and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

The Federation Fuels name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of the Company or its affiliates. You must not use such marks without the prior written permission of the Company.

You are granted a limited, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes. This license does not include the right to reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any content from the Site.

4. USER SUBMISSIONS

By submitting information through the Site's forms (including quote requests and contact forms), you represent and warrant that:

  • All information you provide is true, accurate, current, and complete
  • You have the authority to submit such information
  • Your submission does not violate any applicable law or the rights of any third party

You acknowledge that information submitted through the Site is not confidential and may be used by the Company for the purposes described in our Privacy Policy.

5. DISCLAIMER OF WARRANTIES

THE SITE AND ALL INFORMATION, CONTENT, MATERIALS, AND SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the fullest extent permitted by applicable law, the Company disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The Company does not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

6. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SITE.

The Company's total aggregate liability arising out of or relating to these Terms or your use of the Site shall not exceed one hundred dollars ($100.00).

7. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless the Company, its affiliates, and their respective officers, directors, employees, agents, and representatives from and against all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

8. DISPUTE RESOLUTION

Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof shall first be resolved through good faith negotiation between the parties. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may initiate mediation in Tulsa, Oklahoma.

If mediation is unsuccessful, the dispute shall be submitted to binding arbitration in Tulsa, Oklahoma, administered by the American Arbitration Association under its commercial rules. Each party shall bear its own attorneys' fees and costs. Both parties knowingly and voluntarily waive any right to a trial by jury.

9. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of Oklahoma, without regard to its conflict of laws principles. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the state or federal courts located in Tulsa County, Oklahoma, and you consent to the personal jurisdiction of such courts.

10. MODIFICATIONS TO TERMS

We reserve the right to revise and update these Terms at our sole discretion. All changes are effective immediately when posted and apply to all access to and use of the Site thereafter. Your continued use of the Site following the posting of revised Terms means that you accept and agree to the changes.

11. SEVERABILITY

If any provision of these Terms is determined to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to render it enforceable while preserving the parties' original intent.

12. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Company regarding your use of the Site. These Terms supersede all prior agreements, understandings, and communications, whether written or oral, relating to the subject matter herein.
